    Outset Medical Mislead Investors

    Outset Medical’s flagship product is the Tablo Hemodialysis System, a dialysis machine that purifies tap water and then artificially purifies and removes toxins from the blood of patients suffering from kidney failure.

    Throughout the Class Period, Outset Medical touted that Tablo can “serve as a dialysis clinic on wheels” that had been “cleared by the [U.S.] Food and Drug Administration (FDA) for use in the hospital, clinic or home setting.” However, devices used by non-professionals outside of a clinical setting and that can present serious health consequences like Tablo are subject to heightened scrutiny by the FDA, including post-market surveillance studies. Thus, though cleared by the FDA for sale, Tablo for use in the home setting was subject to additional studies, the results of which could require additional applications for clearance and approvals. And while performing further regulatory studies during the Class Period, Outset Medical assured investors that it was conducting the studies “in accordance with the FDA approved protocol,” which required an appropriate demonstration of “real-world” human testing given that the device would be used at home by non-professionals.

    But as the Outset Medical class action lawsuit alleges, undisclosed to investors, Outset Medical continuously made significant changes to Tablo for use in the home setting. The nature of these undisclosed changes: (i) made it likely that the FDA would order Outset Medical to cease all marketing and selling of Tablo for use in the home pending additional applications and approvals; and (ii) prevented Outset Medical from performing the requisite “real-world” human testing on a device cleared for sale, contrary to representations to investors.

    On May 4, 2022, Tablo Medical announced disappointing results for the first quarter of 2022, which analysts attributed, among other things, to the untested nature of Tablo in the home setting. On this news, the price of Outset Medical common stock declined more than 40% over the three trading days that followed.

    Then, on June 13, 2022, Outset Medical announced that the FDA had forced it to hold all shipments of Tablo for use in the home until Tablo received proper regulatory clearance. During a “Business Update” conference call held that day with analysts, Outset Medical CEO Leslie Trigg acknowledged the “ship hold” had already been in place for weeks before investors were provided this material information. Importantly, CEO Trigg disclosed for the first time that, rather than conducting studies using “real-world data” gathered in the “home environment” as Outset Medical previously stated was required by the FDA, in reality, Outset Medical had “run with a protocol that involves a simulated use environment at a human factors lab.” On this news, the price of Outset Medical stock fell an additional 34%, further damaging investors who suffered losses in Outset Medical stock.

    SOUTHMINSTER, ESSEX, UNITED KINGDOM, June 14, 2022 /EINPresswire.com/ -- After a sustained three-year attempt at establishing the basis of an expansive network of community centres, TROM Computers is calling a halt to further development for the time being. The initiative started with the establishment of TROM Computers CIC at the beginning of the pandemic in 2019.

    The primary reason for pausing is slow adoption by private benefactors and lack of support from UK Government's Department of Employment and Labour. The project's commercial model is based on income that comes entirely from donations, and a main component is a target projection of government funding in line with current unemployment benefit payments. The government essentially pays for people to work with TROM Computers while job searching.

    As a fundamental principle of the project, the TROM Computers staff are paid in a reward-for-effort model where value generated by the project is distributed among people involved, in direct proportion to their individual contributions. Each person records their contribution as 'time chunks' in a web-accessible database where each 'chunk' consists of date, duration and narrative of what is done. There is no distinction between grades of staff, and all value generated is distributed, so there is no mechanism in the share scheme for any one individual in the project to become wealthy from the project, but opportunity in the project for many staff to gain significantly more than they would on a minimum wage assignment or from government handout.

    "This method of sharing has proven a very difficult concept to understand because it is far from what is 'normal' in commercial structures," says Nishanth Shiraj, web applications specialist, "It is only since I experienced a share out myself that I came to fully understand the concept. Concerns for which it is abundantly evident that Politicians are unable to solve, except for when additional effort is expended to harness the power of the Community Concerns initiative that is a core element of the TROM Computers project.

    A priority target for TROM Computers when it re-emerges with full funding, is to implement the Community Concerns initiative by infiltration of local County Councils and Parish Councils and disrupting their bureaucratic operations. Motivation to join Local Councils is in many cases not by genuine interest in resolving community problems, but by self interest and usually related to personal financial gain. As recorded in TROM Computers history when acquisition of public building for use as local premises was filibustered out of the Burnham Town Council agenda in 2020.

    When the TROM Computers project is underway, government policy that sustains a condition of below-poverty-line existence for recipients of social benefits, will be challenged. As an alternative to current policy, benefits recipients will be offered the opportunity to work on the TROM Computers Community Concerns project, utilising their input and at the same time providing them with incentive for self improvement.

    "The main lesson we can learn from our largely unsuccessful start-up, is to accept that the money game is played always for personal gain and hardly ever for community development,' says David Winter, TROM Computers founder, "No politician or local councillor in the current social system is ever going to promote community development unless it involves some kind of personal advantage."

    During the down time of TROM Computers operations, trials will be conducted on a small scale experiment using donations that individuals make in any case for parties considered of worth in community development. An example of these is the Richie Allen radio show that provides a platform for guests whose opinions are often considered unpopular or offensive, but valid nevertheless on the principle that all opinions should be heard and challenged. Richie Allen is a strong proponent of free speech, and plans are in preparation for a 'share out experiment' involving his regular donors who will be offered the option to donate via TROM Computers as a showcase of how the method works as a precursor to pressure on government to support the TROM Computers project.

    Academy members in the documentary branch can view Minnesota! The Modern Day Selma online and beginning today through December 15th can vote to get the film on the short list of 15 documentaries. So far, Minnesota has won 14 film festival awards including the current win of Audience Award Best Documentary at the Culver City Film Festival, added to other awards that include Best Feature Documentary at the Marina Del Rey and Silver State Film Festivals as well as Best Director at the Silicon Beach Film Festival.

    MVD Entertainment releases the film in January.

    The Academy Qualifying Theatrical release was in October in a time, post covid, when almost anything can happen, Minnesota racked up an impressive weekend per screen average of $1,420 on a single screen at the Laemmle Monica Film Complex in Santa Monica. Minnesota beat out big screen films including Disney’s Shang-Chi and the Legend of the Ten Rings, Jungle Cruise, 20th Century Studios The Last Duel, Free Guy, Bleeker Street’s Mass, I’m your Man, A24’s Lamb, National Geographic’s Becoming Cousteau, Universal’s Candyman, Dear Evan Hansen and Searchlight’s The Eyes of Tammy Faye: In most cases by nearly double.

    Most people that see the film comment that they never knew that families, other than George Floyd’s, have been impacted by police violence. Minnesota tells the stories of other incidents that happened previous to the George Floyd Murder. These stories are all extremely emotional and audience members get to experience the pain through the family members’ eyes.

    Michael Douglas Carlin comes from a well-established Hollywood family having sat on Fess Parker’s lap as a young child. Carlin’s grandfather worked in the movie business as a driver and teamster driving for Cecil B. DeMille, Howard Hughes and many others. His last assignment before retirement was as a driver on the Steven Spielberg film, JAWS. His father worked in the industry as a gaffer before working full-time in the lighting equipment rental business, Keylite PSI, a company that Carlin’s father founded.

    Michael was a kid hanging out on the movie sets including: Ode to Billy Joe, (he had a bit part as an actor where he was directed by Max Baer Jr.); the 1976 remake of the movie, King Kong where he worked as a movie extra; and young Michael spent a summer in Chicago on the film The Fury directed by Brian DePalma where he bounced between working as an extra and a set electrician. Both King Kong and The Fury were filmed by acclaimed cinematographer, Richard Kline who would reunite with Michael Douglas Carlin on the film, Body Heat directed by Lawrence Kasdan. Carlin worked on Body Heat as a set electrician.

    Carlin would later run family business Keylite PSI that supplied equipment on many notable films like Robert Redford’s Ordinary People; Brian DePalma’s the Untouchables; Oliver Stone’s JFK and Platoon; Quentin Tarantino’s Reservoir Dogs; Neal Israel’s Bachelor Party; Robert Altman’s Fool For Love; John Frankenheimer’s 52 Pickup; David Lynch’s Twin Peaks; Sean Penn’s The Indian Runner; Aaron Norris’ Braddock; Blake Edwards’ That’s Life; among hundreds of others. Keylite PSI also supplied the equipment for the first night landing of the Space Shuttle Challenger, the 1979 & 1980 Academy Awards®, and for over a dozen years supplied the equipment on the Hollywood Christmas Parade an event that young Michael worked on every year. Carlin also ran two motion picture studios – Valencia Studios and Osmond Studios. In recent years Carlin directed American Federale, Tupac Assassination Battle for Compton, Larger than Life the Suge Knight Story and he Executive Produced along with Stephen Nemeth, Hearts Road directed by Colin Finlay.

    In the mid to late 80s Carlin teamed up with Michael Meyer to produce a dozen low budget movies. Meyer, an entertainment lawyer, came from the management side of the business having worked with David Stewart and Larry Thompson. Meyer, was also a product of the movie business as his father personally represented Jules Stein and Lew Wasserman in the formation of Music Corporation of America, Universal Pictures and Universal Studios. Marvin Meyer of the firm of Rosenfeld, Meyer, and Sussman also represented Grace Kelly, Marilyn Monroe, Marlon Brando, and hundreds of other notable clients.

    Michael Meyer and his company Native Stars reunited with Carlin to work on Minnesota! The Modern Day Selma. Meyer said, “Minnesota, fits in with Native Stars’ mission to inspire others to make a difference wherever they can. We are proud of our participation in this important film and applaud the director, Michael Douglas Carlin, with whom I have had a longstanding business and personal friendship for many decades.”

    Producing the movie, Minnesota, is Omar Bradley, the former Mayor of Compton. Bradley brought tremendous depth to the project and shaped the editing process. Bradley is known for closing down the Compton Police Department when it was discovered by internal auditors that a large amount of evidence was missing from the evidence locker including cocaine and weapons. The Los Angeles Sheriffs Department took on the policing of Compton and their contract continues to this day. Bradley was unseated as Mayor in a controversial election that was overturned by a Superior Court Judge and Bradley was unseated again by the Appellate Court. When Compton was turned over to the new mayor there was no debt and $63 million in the bank, in stark contrast to the debt laden Compton of today.

    Said Carlin, “Who better to produce such as salient documentary than a man from the inner-cities that understands the delicate balance between policing and the community? Bradley served as a City Councilman and Mayor. Additionally, now Omar has become an award-winning filmmaker to add to his growing body of work that includes being a published author.”

    The film is likely to remain relevant under the current climate with qualified immunity impossible to overturn at the Supreme Court level. Communities and their police departments must work out their differences much like a family having a meeting at the dinner table. “We hope our film can help facilitate these important conversations,” said Bradley. “Families have experienced pain and every officer should at a minimum be aware of what families feel when they lose a loved one.”

    TOKYO, JAPAN, December 13, 2021 /EINPresswire.com/ -- The "Nanatsuboshi in Kyushu" is a luxury cruise train operated by Japan's JR Kyushu that has attracted the attention and interest of travelers from around the world. Here, the vehicle's designer talks about the "work ethic and determination" that helped make the train a reality.

    In October 2021, the American magazine Condé Nast Traveler announced the results of its Readers' Choice Awards 2021, and the "Nanatsuboshi in Kyushu" took first place in the railroad train category. The ranking was based on readers' votes concerning travel.

    This ranking is considered the most prestigious accolade to be granted by readers through voting based on their travel experiences, and it was announced that over 800,000 readers had cast their votes for the Condé Nast Traveler's Readers' Choice Awards 2021. In addition to railroad trains, other categories such as cities, hotels, and cruise ships were ranked by the magazine.

    The "Nanatsuboshi in Kyushu" is Japan's first cruise train, which JR Kyushu began operating in October 2013. It is a one-of-a-kind railroad experience that integrates the skills and spirit that characterize the culture of Japan's island of Kyushu, and it has attracted a large number of reservations from Japan and overseas despite having just 12 cabins. The concept behind the train is "a journey to encounter a new life."

    Nikkei BP published a book titled "The Spirit of Railroad Design: The Struggle to Create Things that Never Existed" in 2015, in which Seiji Mitooka, the designer of the "Nanatsuboshi in Kyushu" and many other railroad-related projects, reveals his efforts to create trains and stations that had never before been seen by the world.

    This valuable text was written by Mr. Mitooka with the intention of explaining, for the final time (aside from books such as those in his design collection) his work philosophy and way of thinking.

    "Is it possible for me to conduct design work without being present next to the JR Kyushu railroad tracks? I want to stand in the user's shoes." By so doing, the author persuades his clients - railroad companies, rolling stock manufacturers and the Ministry of Land, Infrastructure, Transport and Tourism - to accept what he thinks are the best solutions to meet their needs. In the process, he admits, he sometimes comes to change his own concepts and ideas.

    Mr. Mitooka describes the work of a designer as "taking in the customer's demands, negotiating, compromising, managing the budget, cutting prices, issuing invoices and crawling around on the ground to bring something new into being." It's not like being an artist, he explains, where one has to give birth to something based on what comes out of the creator. Rather, it is a task that is very similar to the work performed by engineers and designers. As such, Mr. Mitooka believes it should be associated with the Japanese term monozukuri, which is often used in connection with concepts like "craftwork" or "manufacturing." The perspective is one that always focuses on the experiences of those who ride the trains and use the stations in question.

    The book also mentions Mr. Mitooka's work in 2015, including JR Kyushu's "Aru Train" and the renovation of Oita Station. It devotes a large number of pages to describing the truly collaborative process of manufacturing together with the many craftspeople who work on the interior and exterior of the train cars and related items, including Kakiemon Sakaida XIV, who was in charge of the washbasins for the Nanatsuboshi. While there are many hints and tips scattered throughout the book that can help the reader prepare for his or her own work, it is also a text that offers a rich and telling behind-the-scenes look at railroad design.

    Voting on the film by the Documentary Branch of the Academy of Motion Picture Arts and Sciences® begins today through the 15th. If the film garners enough support it will be included on the short list of 15 films to be announced on the 21st of December. Faizon Love said, “Minnesota!     Minnesota! The Modern Day Selma, winner of 13 Film Festival Awards is now live in the Academy Screening Room for Oscar® consideration. Said film director, Michael Douglas Carlin, “we were in Minnesota when buildings were burning in a dangerous situation capturing the essence of the George Floyd Murder protests. Our Film sheds light on the issue of police violence as several families tell heartfelt stories detailing their loss of a family member.”

    At the event, Knifewing Segura said he understood the frustration with law enforcement having worked in their ranks for many years. He agreed that police and communities must sit at the table to sort out their differences instead to simply stripping funds from law enforcement organizations. “Much of what we are facing is due to budget cuts that eliminate valuable training,” said Knifewing. “We must make every dollar count by eliminating the drag on policing due to corrupt police officers. They need to find their way out of police departments.”

    Former Mayor of Compton and Producer of Minnesota agreed wholeheartedly. He is widely known as the mayor that stood up to corrupt police officers that stole evidence out of the Compton Evidence Locker. When he left Compton, the city had a $63 million dollar surplus and contracting with the sheriffs eliminated millions of dollars every year from the city budget. Bradley is looking forward to making films with the Apache Tribes as his alma mater is the Centennial High School Apache. “It simply feels like a homecoming to me.”

    “Knifewing and Bradley became fast friends at the event as they share so many interests,” said Carlin, “Knifewing came from a background in law enforcement to filmmaking and Bradley as the former Mayor of Compton was able to see film production through the eyes of his friend, Eazy-E. Now Bradley is a full-time filmmaker. Both men shared their stories with each other until late into the night.”

    Academy members in the documentary branch can view Minnesota! The Modern Day Selma online and beginning today through December 15th can vote to get the film on the short list of 15 documentaries. So far, Minnesota has won 13 film festival awards including Best Feature Documentary at the Marina Del Rey and Silver State Film Festivals as well as Best Director at the Silicon Beach Film Festival. MVD Entertainment releases the film in January.

    The Academy Qualifying Theatrical release was in October in a time, post covid, when almost anything can happen, Minnesota racked up an impressive weekend per screen average of $1,420 on a single screen at the Laemmle Monica Film Complex in Santa Monica. Minnesota beat out big screen films including Disney’s Shang-Chi and the Legend of the Ten Rings, Jungle Cruise, 20th Century Studios The Last Duel, Free Guy, Bleeker Street’s Mass, I’m your Man, A24’s Lamb, National Geographic’s Becoming Cousteau, Universal’s Candyman, Dear Evan Hansen and Searchlight’s The Eyes of Tammy Faye: In most cases by nearly double.

    Most people that see the film comment that they never knew that families, other than George Floyd’s, have been impacted by police violence. Minnesota tells the stories of other incidents that happened previous to the George Floyd Murder. These stories are all extremely emotional and audience members get to experience the pain through the family members’ eyes.

    Michael Douglas Carlin comes from a well-established Hollywood family having sat on Fess Parker’s lap as a young child. Carlin’s grandfather worked in the movie business as a driver and teamster driving for Cecil B. DeMille, Howard Hughes and many others. His last assignment before retirement was as a driver on the Steven Spielberg film, JAWS. His father worked in the industry as a gaffer before working full-time in the lighting equipment rental business, Keylite PSI, a company that Carlin’s father founded.

    Michael was a kid hanging out on the movie sets including: Ode to Billy Joe, (he had a bit part as an actor where he was directed by Max Baer Jr.); the 1976 remake of the movie, King Kong where he worked as a movie extra; and young Michael spent a summer in Chicago on the film The Fury directed by Brian DePalma where he bounced between working as an extra and a set electrician. Both King Kong and The Fury were filmed by acclaimed cinematographer, Richard Kline who would reunite with Michael Douglas Carlin on the film, Body Heat directed by Lawrence Kasdan. Carlin worked on Body Heat as a set electrician.

    Carlin would later run family business Keylite PSI that supplied equipment on many notable films like Robert Redford’s Ordinary People; Brian DePalma’s the Untouchables; Oliver Stone’s JFK and Platoon; Quentin Tarantino’s Reservoir Dogs; Neal Israel’s Bachelor Party; Robert Altman’s Fool For Love; John Frankenheimer’s 52 Pickup; David Lynch’s Twin Peaks; Sean Penn’s The Indian Runner; Aaron Norris’ Braddock; Blake Edwards’ That’s Life; among hundreds of others. Keylite PSI also supplied the equipment for the first night landing of the Space Shuttle Challenger, the 1979 & 1980 Academy Awards®, and for over a dozen years supplied the equipment on the Hollywood Christmas Parade an event that young Michael worked on every year. Carlin also ran two motion picture studios – Valencia Studios and Osmond Studios. In recent years Carlin directed American Federale, Tupac Assassination Battle for Compton, Larger than Life the Suge Knight Story and he Executive Produced along with Stephen Nemeth, Hearts Road directed by Colin Finlay.

    In the mid to late 80s Carlin teamed up with Michael Meyer to produce a dozen low budget movies. Meyer, an entertainment lawyer, came from the management side of the business having worked with David Stewart and Larry Thompson. Meyer, was also a product of the movie business as his father personally represented Jules Stein and Lew Wasserman in the formation of Music Corporation of America, Universal Pictures and Universal Studios. Marvin Meyer of the firm of Rosenfeld, Meyer, and Sussman also represented Grace Kelly, Marilyn Monroe, Marlon Brando, and hundreds of other notable clients.

    Michael Meyer and his company Native Stars reunited with Carlin to work on Minnesota! The Modern Day Selma. Meyer said, “Minnesota, fits in with Native Stars’ mission to inspire others to make a difference wherever they can. We are proud of our participation in this important film and applaud the director, Michael Douglas Carlin, with whom I have had a longstanding business and personal friendship for many decades.”

    Producing the movie, Minnesota, is Omar Bradley, the former Mayor of Compton. Bradley brought tremendous depth to the project and shaped the editing process. Bradley is known for closing down the Compton Police Department when it was discovered by internal auditors that a large amount of evidence was missing from the evidence locker including cocaine and weapons. The Los Angeles Sheriffs Department took on the policing of Compton and their contract continues to this day. Bradley was unseated as Mayor in a controversial election that was overturned by a Superior Court Judge. Bradley was unseated by the Appellate Court. When Compton was turned over to the new mayor there was no debt and $63 million in the bank, in stark contrast to the debt laden Compton of today.

    Said Carlin, “Who better to produce such as salient documentary than a man from the inner-cities that understands the delicate balance between policing and the community? Bradley served as a City Councilman and Mayor. Additionally, now Omar has become an award-winning filmmaker to add to his growing body of work that includes being a published author.”

    The film is likely to remain relevant under the current climate with qualified immunity impossible to overturn at the Supreme Court level. Communities and their police departments must work out their differences much like a family having a meeting at the dinner table. “We hope our film can help facilitate these important conversations,” said Bradley. “Families have experienced pain and every officer should at a minimum be aware of what families feel when they lose a loved one.”
